Important notice: TrackTrading is a trading journal and analytics tool only. It does not execute trades, provide investment advice, or act as a financial intermediary. Nothing in this Service constitutes financial, investment, legal, or tax advice. Trading financial instruments involves significant risk of loss.

1. Parties and Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and Brazhelp Solutions Ltd, a company incorporated in England and Wales (Company Registration Number: 13259174), with its registered office at 124 City Road, London, EC1V 2NX, United Kingdom ("we", "us", "our", "the Company").

By accessing or using TrackTrading through the website at tracktrading.cloud, the iOS application (available on the Apple App Store), the Android application (available on Google Play), or any related services ("the Service"), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not use the Service.

These Terms apply to all platforms on which TrackTrading is available, including web browsers, iOS devices, and Android devices. Additional terms may apply to specific features or services, and will be presented to you at the time of use.

2. Description of Service

TrackTrading is a trading journal and performance analytics platform operated by Brazhelp Solutions Ltd. The Service enables traders to log trade positions, track profit and loss, analyse performance metrics (including win rate, Sharpe ratio, Sortino ratio, maximum drawdown, and consistency score), set daily, weekly, and monthly targets, connect broker accounts for automated trade import, and share performance data with other users on a voluntary basis.

The Service is a record-keeping and analysis tool only.Brazhelp Solutions Ltd does not execute trades, provide investment advice, manage client funds, hold client assets, or act as a broker, dealer, or financial intermediary of any kind. Brazhelp Solutions Ltdis not authorised or regulated by the Financial Conduct Authority (FCA), the Commission de Surveillance du Secteur Financier (CSSF), the Securities and Exchange Commission (SEC), or any other financial regulatory authority in connection with this Service.

3. Eligibility

You must be at least 18 years of age to register for and use the Service. By creating an account, you represent and warrant that: you are at least 18 years old; you have the legal capacity to enter into a binding agreement under the laws of your jurisdiction; all information you provide during registration is accurate, current, and complete; and your use of the Service does not violate any applicable law or regulation in your jurisdiction. If you are using the Service on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

4. Account Registration and Security

You may register for an account using your email address, Sign in with Apple, or Google Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, whether or not authorised by you. You agree to: provide accurate and complete information during registration; keep your login credentials secure and confidential; notify us immediately at [email protected] if you become aware of any unauthorised access to or use of your account; and not share your account credentials with any third party. Brazhelp Solutions Ltd shall not be liable for any loss or damage arising from your failure to maintain the security of your account credentials.

5. Subscription Plans, Billing, and In-App Purchases

TrackTrading offers both free trial and paid subscription plans. Paid plans are billed in advance on a monthly or annual basis. Lifetime plans are a single, one-time payment. All prices are displayed inclusive of applicable taxes unless otherwise stated.

5.1 Web Subscriptions (Stripe)

Subscriptions purchased through the TrackTrading website are processed by Stripe, Inc. and are subject to Stripe's terms of service. Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time via the Stripe Customer Portal, accessible from your account Settings. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until that date.

5.2 iOS In-App Purchases (Apple)

Subscriptions purchased through the iOS app are processed by Apple and are subject to Apple's terms and conditions for in-app purchases and auto-renewable subscriptions. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel subscriptions by going to your Apple ID account settings after purchase. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

5.3 Android In-App Purchases (Google Play)

Subscriptions purchased through the Android app are processed by Google and are subject to Google Play's terms of service for in-app purchases. Payment will be charged to your Google account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions through the Google Play Store app or Google Play website.

5.4 Free Trial

A free trial period may be available on selected plans. No payment method is required to commence a trial on the web platform. For iOS and Android trials, your payment method may be required but will not be charged until the trial period expires. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.

5.5 Refunds

No refunds are issued for partial billing periods for web subscriptions, except where required by applicable law (including the UK Consumer Rights Act 2015 for digital services). For iOS purchases, refund requests must be submitted to Apple. For Android purchases, refund requests must be submitted to Google. Brazhelp Solutions Ltd does not process refunds for purchases made through the Apple App Store or Google Play Store.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. In particular, you agree not to: use the Service for any unlawful purpose or in violation of any applicable regulation; attempt to gain unauthorised access to any part of the Service, its servers, or any related systems; reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service; use automated tools, bots, or scripts to scrape, extract, or harvest data from the Service; share your account credentials with any third party or allow multiple individuals to use a single account; upload, transmit, or distribute malicious code, viruses, or any material that could interfere with the operation of the Service; impersonate any person or entity, or misrepresent your affiliation with any person or entity; use the Service to provide financial advice, investment recommendations, or any regulated financial service to third parties; or circumvent, disable, or otherwise interfere with any security-related features of the Service.

Brazhelp Solutions Ltd reserves the right to investigate and take appropriate action against any User who, in our sole discretion, violates this provision, including suspending or terminating the User's account without notice or refund.

7. User Content and Data Ownership

All trade data, journal entries, notes, and performance records that you input into the Service ("User Content") remain your property at all times. You grant Brazhelp Solutions Ltd a limited, non-exclusive, royalty-free licence to store, process, and display your User Content solely for the purpose of providing the Service to you and, where you have enabled a public profile, to display your aggregate performance statistics to other users.

You may export your User Content at any time in CSV or PDF format from the web application. Upon account deletion, all User Content is permanently and irreversibly erased from our systems.Brazhelp Solutions Ltd does not claim any ownership rights over your User Content. You are solely responsible for the accuracy and legality of the User Content you submit.

8. Public Profiles and Social Features

TrackTrading includes optional social features, including public trader profiles, a community leaderboard, and a follower system. These features are entirely opt-in. By enabling a public profile, you consent to your nickname, avatar, aggregate performance statistics, and trade history being visible to other registered users and, where applicable, to the general public.

You may revert your profile to private at any time from Settings. Brazhelp Solutions Ltd is not responsible for any use that other users make of publicly shared performance data. Public performance data does not constitute investment advice or a recommendation to replicate any trading strategy. You acknowledge that past performance displayed on public profiles does not guarantee or predict future results.

9. Broker Connections and Automated Import

TrackTrading allows you to connect third-party broker accounts (including MetaTrader MT4/MT5 via MetaApi and Interactive Brokers via Flex Web Service) to automatically import trade history. By connecting a broker account, you: authorise TrackTrading to access your trade history from the connected broker; acknowledge that Brazhelp Solutions Ltd is not responsible for any errors, omissions, or delays in the data provided by your broker; understand that broker connection credentials are encrypted and stored securely, and can be disconnected at any time; and accept that Brazhelp Solutions Ltddoes not execute, modify, or cancel any trades on your behalf through these connections.

Broker connections are read-only. TrackTrading only imports historical trade data and does not have the ability to place, modify, or cancel orders.

10. Intellectual Property

All content, design, code, trademarks, logos, and branding of TrackTrading — excluding User Content — are the exclusive intellectual property of Brazhelp Solutions Ltd and its licensors. This includes the TrackTrading name, logo, mobile app icon, website design, analytics algorithms, and all associated documentation. Nothing in these Terms grants you any right, title, or interest in Brazhelp Solutions Ltd's intellectual property. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any part of the Service without our prior written consent.

11. No Financial Advice or Regulated Activity

All performance metrics, statistics, analytics, risk scores, and data presented within TrackTradingare provided for informational and record-keeping purposes only. They do not constitute financial advice, investment recommendations, or any form of regulated financial activity under the Financial Services and Markets Act 2000 (FSMA), the Markets in Financial Instruments Directive (MiFID II), or any other applicable legislation.

Past trading performance recorded in the Service does not guarantee or predict future results. Trading financial instruments — including but not limited to equities, forex, commodities, options, futures, and contracts for difference (CFDs) — involves significant risk of loss, including the potential loss of your entire invested capital. You should seek independent professional advice from a qualified financial adviser before making any investment decisions.

Brazhelp Solutions Ltd accepts no responsibility for any trading losses, investment decisions, or financial outcomes incurred as a result of using the Service. The inclusion of any instrument, ticker, or market data within the Service does not constitute an endorsement, recommendation, or solicitation to trade that instrument.

12. Investment Risk Disclaimer

Risk Warning: Trading financial instruments carries a high level of risk and may not be suitable for all investors. The high degree of leverage available in certain markets can work against you as well as for you. Before deciding to trade, you should carefully consider your investment objectives, level of experience, and risk appetite. There is a possibility that you could sustain a loss of some or all of your initial investment. You should not invest money that you cannot afford to lose. If you are in any doubt, you should seek advice from an independent financial adviser.

TrackTrading is a journal and analytics tool. It does not provide signals, recommendations, or managed accounts. Any performance data displayed — whether your own or on public profiles — reflects historical records only and should not be interpreted as indicative of future performance.

13. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. Brazhelp Solutions Ltd does not warrant that: the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components; the accuracy, completeness, or timeliness of any data, analytics, or metrics presented within the Service; that any broker connection will import data without errors or delays; or that the Service will meet your specific requirements or expectations.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Brazhelp Solutions Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, loss of data, loss of goodwill, trading losses, investment losses, or business interruption, arising out of or in connection with your use of or inability to use the Service, even if Brazhelp Solutions Ltd has been advised of the possibility of such damages.

In no event shall Brazhelp Solutions Ltd's total aggregate liability to you for all claims arising out of or in connection with these Terms or the Service exceed the total amount paid by you toBrazhelp Solutions Ltd in the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred pounds sterling (£100), whichever is greater.

Nothing in these Terms shall limit or exclude Brazhelp Solutions Ltd's liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded or limited under applicable law, including the Consumer Rights Act 2015.

15. Indemnification

You agree to indemnify, defend, and hold harmless Brazhelp Solutions Ltd, its directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: your use of the Service; your breach of these Terms; your violation of any applicable law or regulation; your User Content; or any trading decisions you make based on data displayed within the Service.

16. App Store and Google Play Terms

If you access TrackTrading through the Apple App Store or Google Play Store, the following additional terms apply:

16.1 Apple App Store

These Terms are between you and Brazhelp Solutions Ltd only, and not with Apple Inc. ("Apple"). Apple has no obligation to furnish any maintenance or support services with respect to the TrackTradingapp. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the app. Apple is not responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of the app, including but not limited to: product liability claims; any claim that the app fails to conform to any applicable legal or regulatory requirement; and claims arising under consumer protection, privacy, or similar legislation. Apple is not responsible for the investigation, defence, settlement, or discharge of any third-party claim that the app infringes that third party's intellectual property rights. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

16.2 Google Play Store

These Terms are between you and Brazhelp Solutions Ltd only, and not with Google LLC ("Google"). Google is not responsible for the TrackTrading app or its content. Google has no obligation to provide maintenance, support, or warranty services for the app. If the app does not conform to any applicable warranty, Google is not liable for any refund of the purchase price. Google is not responsible for addressing any claims by you or any third party relating to the app, including product liability, consumer protection, or intellectual property claims. Your use of the app is also subject to the Google Play Terms of Service.

17. Account Deletion and Termination

You may delete your account at any time from Settings → Danger Zone → Delete Account in the web application or mobile app. Upon deletion, all your personal data and User Content are permanently and irreversibly erased. Any active paid subscription will be cancelled, and no refund will be issued for the remaining period of the current billing cycle, except as required by law. For subscriptions purchased through the Apple App Store or Google Play Store, you must also cancel the subscription through the respective store to prevent further charges.

Brazhelp Solutions Ltd reserves the right to suspend or terminate your account, with or without notice, if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law. Upon termination by either party, your right to access and use the Service ceases immediately.

18. Modifications to the Service

Brazhelp Solutions Ltd reserves the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of material changes that may affect your use of the Service. Brazhelp Solutions Ltd shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

19. Changes to These Terms

Brazhelp Solutions Ltd may update these Terms from time to time to reflect changes in our business practices, applicable law, or the features of the Service. We will provide notice of material changes via email to your registered address, via an in-app notification, or via an update notice within the mobile app, at least 14 days before the changes take effect. The "Last updated" date at the top of this page will reflect the most recent revision. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and delete your account before the effective date.

20. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, subject to any mandatory consumer protection laws in your jurisdiction that cannot be waived by agreement.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The failure of Brazhelp Solutions Ltd to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

21. Dispute Resolution

In the event of any dispute arising out of or in connection with these Terms, the parties shall first attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved within 30 days of written notice, either party may commence formal legal proceedings in accordance with Section 20. Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction at any time.

For users resident in the European Union, you may also be entitled to submit a complaint through the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

22. Force Majeure

Brazhelp Solutions Ltd shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, acts of government, war, terrorism, civil unrest, power outages, internet service disruptions, cyberattacks, or failures of third-party infrastructure providers.

23. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Brazhelp Solutions Ltd with respect to the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and Brazhelp Solutions Ltd regarding the Service. Any additional terms applicable to specific features or promotions will be presented to you at the time of use and are incorporated by reference.
